GENERAL TERMS AND CONDITIONS OF MOTORCYCLE TOURS № __

These General Terms and Conditions form an integral part of the travel agreement between Sole Proprietor "Asia Rent" (the Organizer) and ____________ (the Participant).

1. SUBJECT OF THE AGREEMENT

The Organizer agrees to provide the Participant with services (_______ motorcycle tour from //2024 to //2024), and the Participant agrees to pay the Organizer for the provided travel services, which include a motorcycle, car support with a mechanic, guide, accommodation, and meals.

2. PAYMENT

Upon reservation confirmation, the Participant will receive an invoice from the Organizer. Payment must be made as follows:

  • Reservation Deposit: USD ___, to be paid within 10 days of receiving the invoice.
  • Final Payment: USD _____, to be paid 30 days before the start of the tour or in cash upon arrival.
  • Total Payment: USD ______.
If transportation costs or fees for services increase after signing the contract (e.g., due to currency exchange rate changes), the Organizer reserves the right to adjust the cost of the tour. The Organizer will notify the Participant. If the increase exceeds 10%, the Participant may cancel the tour and receive a full refund, minus bank commissions.

3. SERVICES AND PRICES

The Participant must pay for any additional services requested during the tour. Minor changes to the scheduled routes or accommodations will not be considered a breach of contract, provided these changes do not significantly alter the overall character of the tour. Motorcycle tours require a higher degree of participation and cooperation from the Participant compared to conventional package tours. Many aspects are unpredictable and cannot be fully planned in advance. The Organizer expects the Participant to understand and accept any necessary changes.

4. CANCELLATION BY THE PARTICIPANT

The Participant may cancel the tour in writing at any time before the start of the tour. The date of receipt of the cancellation by the Organizer will be considered definitive. If the Participant cancels, the Organizer may retain the deposit as cancellation costs. No refunds will be given if the Participant fails to arrive or arrives too late for the tour departure. If the Participant misses the return trip, they must arrange their return journey at their own expense, and the Organizer will provide no compensation.
Changes to scheduled dates, times, and destinations are only possible by canceling the existing agreement and booking a new tour. No refunds will be given for unused services included in the tour price.

5. CANCELLATION BY THE ORGANIZER

The Organizer reserves the right to cancel the tour up to 30 days before the start date if the minimum number of participants is not met. In this case, the Participant will be notified, and their deposit will be refunded, minus bank transfer fees. The Organizer is not responsible for other expenses, such as tickets or insurance.
In cases of force majeure (strikes, terror attacks, COVID restrictions, natural disasters, etc.), the Organizer may cancel the tour. In this case, the deposit will be valid for a future date, and no further claims or refunds will be provided. The Organizer may also terminate the tour early for the aforementioned reasons, in which case the Participant will be reimbursed for accommodations and meals for the remaining days of the tour (excluding flight costs).
In the event of undisciplined, dangerous, or disruptive behavior, or disregard for traffic laws, the Organizer and their authorized guides reserve the right to exclude the Participant from the tour. In this case, the Organizer may reclaim the motorcycle, and no refund will be provided.

6. PREMATURE TERMINATION BY THE PARTICIPANT

If the Participant terminates the tour early for any reason, they will not be entitled to a refund for unused services. If early termination is due to compelling reasons (e.g., illness, accident, family emergency), the Organizer will assist in arranging the return trip home, as far as possible.

7. COMPLIANCE WITH RULES AND REGULATIONS

The Participant is responsible for complying with local road traffic regulations and is liable for any damage caused to other participants or road users. This applies even when following the tour guide. The Participant must adapt their riding style for their own safety. The Organizer is not liable for injury or death of a Participant during the tour, and no further claims will be accepted.

8. RESPONSIBILITY FOR THE MOTORCYCLE

The Organizer provides the motorcycle (Suzuki 650SE, plate № ________) in good technical condition under a Transfer and Acceptance Act for temporary use. The Participant is fully responsible for any damage to the rented motorcycle during the tour. In the event of damage, the Participant must reimburse the cost as per the Transfer and Acceptance Act. If the motorcycle is completely damaged or destroyed, the Participant must provide a replacement motorcycle or pay its market value (USD 8000) within two days.
The Participant must provide a refundable damage deposit of USD 500 for potential minor damages. Evacuation of the motorcycle in case of damage is at the Participant’s expense (USD 0.60 per kilometer).

9. PASSPORT, VISAS, HEALTH REGULATIONS, AND DRIVER'S LICENSE

The Organizer does not assist with visas. The Participant is responsible for obtaining the necessary visas and ensuring compliance with all health regulations, driving licenses, and permits in the countries visited. If the Participant cannot join or must leave the tour due to failure to meet these requirements, no refunds will be provided.

10. INSURANCE

The Participant is responsible for choosing an appropriate insurance company to cover accidents, motorcycle damage, third-party liability, and trip cancellation due to force majeure.

11. MOTORCYCLE CLOTHING AND PROTECTIVE GEAR

The Participant is responsible for selecting appropriate motorcycle clothing and protective gear.

12. ORGANIZER LIABILITY

The Organizer is responsible for the proper preparation of the tour, including selecting service providers and ensuring that agreed-upon services are delivered.

13. WEATHER LIABILITY

The Organizer may change the tour route and accommodations due to weather conditions. The Organizer will make every effort to maintain the tour’s character and provide high-quality services, but will not be liable for disruptions caused by adverse weather conditions.

14. TOUR CHARACTERISTICS

The Participant understands that the tour takes place in countries with limited infrastructure and service quality. Accommodation may vary in comfort and quality, and delays may occur due to border crossings, fuel shortages, or breakdowns. The Participant accepts these conditions and no refunds will be provided in these cases.

15. HEALTH

The Participant must assess their health and physical fitness before the tour. Some routes are remote, and medical care may be difficult to access. The tour requires physical endurance and mental preparation for adverse weather and road conditions, including high-altitude travel, long distances, and difficult terrain.
