THESE GENERAL TERMS AND CONDITIONS OF MOTORCYCLE TOURS № __

These General Terms and Conditions of the contractual agreement are a constituent part of the travel agreement between Sole Proprietor "Asia Rent" (organizer) and ____________ (the participant).
1. SUBJECT OF THE AGREEMENT

The organizer undertakes to provide the participant services (_______ Motorcycle tour from __/__/2024 to __/__/2024) and the Customer undertakes to pay the Organizer for the provided travel services which are including (motorcycle, car support with a mechanic, guide, accommodation and meals).

2. PAYMENT
Together with the reservation confirmation, the participant of tour will receive an invoice from the organizers of a trip that is to be paid as follows:
• Reservation deposit – USD ___ the participant of tour has to payment within 10 days after receiving an invoice.
• Final payment of the remaining amount -USD _____ must be paid 30 days before the start of the tour or cash on arrival
Total payment: USD______
If transportation costs (fees for certain services, currency exchange rates increase after signing a contract, the organizers reserve the right to adjust the cost of the tour.
The organizer notifies the participant. If the increase in the price is more than 10%, the participant can cancel tour and receive all his advance payments back considering the bank's commissions.

3. SERVICES AND PRICE
The participant must provide additional payment for any individual services that he/she may require during the tour.
Any changes to the scheduled routes or overnight accommodation shall not be considered as a change to the offered services provided the changes, deviations or variations do not substantially alter the overall character of the booked trip. The motorcycle trip demands a higher degree of participation and cooperation on the participant of tour part than a conventional package tour. Many aspects are not completely predicable and cannot be fully planned in advance. The organizers therefore hope the participant of tour will appreciate any changes that may prove to be necessary.

4. CANCELLATION BY THE PARTCIPANT

The participant of tour may cancel the trip in writing at any time before the start of the tour. The date of receipt of the cancellation by the organizers of a tour shall be decisive. If the participant of tour cancels a tour, the organizers of a trip shall be entitled to demand cancellation costs transferred deposit.
The payment will not be refunded if the participant of tour does not arrive or arrives too late for the departure. If the participant of tour misses the return flight or trip home, he/she himself/herself must organize the return journey. The participant of tour shall not be entitled to any compensation from the organizers of a tour.
Changes to scheduled dates, time and destinations are possible only by cancelling the existing agreement and subsequently booking a new tour.
The participant is not entitled to demand a refund if he did not use any service included in the tour price.

5. CANCELLATION BY THE ORGANIZERS OF TOUR
The organizers of a trip shall be entitled to cancel a trip up to 30 days before the start of the tour if the minimum number of participants has not been booked. In this case, the participant shall be notified accordingly and participant's deposit will be returned minus bank transfer fees. No further claims or demands for a refund of your already paid expenses for tickets, insurance, etc. shall be accepted.
If it is necessary to cancel a trip for reasons outside our control on the territory of the planned tours (force major, strikes, terror attacks, Covid restrictions, accidents, nature disasters or similar), the reservation deposit already paid by you shall not be. But this deposit is valid till the next date. No further claims or demands shall be accepted.
We also reserve the right to terminate the tour prematurely for the aforementioned reasons. In such cases, we shall reimburse the amount (accommodations and food) equivalent to the remaining days of the tour (excluding any flight costs). No further claims or demands shall be accepted.
In the event of undisciplined, dangerous or disruptive behavior as well as disregard of road traffic regulations, the organizers of a trip and his authorized tour guides shall be entitled to exclude you from the trip. In this case, the organizers have the right to withdraw the motorcycle. Money for a tour does not come back to participant.

6. PREMATURE TERMINATION OF THE TOUR BY PARTICIPANT
If, for any reason whatsoever, you terminate the tour prematurely, you shall not be entitled to reimbursement of outstanding services charged by the organizers of a tour to your account. If it is necessary for you to prematurely terminate the tour for a compelling reason, e.g., due to illness or accident or serious illness or death of a close family relative etc. the organizers of a tour shall assist as far as possible in organizing the return trip home.

7. COMPLYING WITH RULES AND REGULATIONS

The participant shall be responsible for complying with the respective road traffic regulations. Participant at your own peril and shall be liable for any damage he may inflict on fellow tour participants or other road users. This requirement also applies when you are following the guide. You must adapt your riding style in the interest of your own safety.
In case of injury or death of a participant during the tour, the organizers are not responsible. No further claims or demands shall be accepted.

8. RESPONSIBILITY FOR THE PROVIDED MOTORCYCLE
The organizers provide the participant the motorcycle in good technical condition under the Transfer and Acceptance Act  for temporary use (motorcycle model Suzuki 650SE, plate № ________ belonging to the organizer as a property.
The participant is fully responsible for any possible damage to the rented motorcycle during the riding in the tour.
In the event of damage to the motorcycle, the participant shall reimburse the organizer the cost of the damage according to the Transfer and Acceptance Act. And in case of complete damage to the motorcycle or its destruction, which makes it impossible for the normal operation of the motorcycle The Lessee must to provide an equivalent motorcycle or pay its actual cost for two (2) days. Actual market price of motorcycle Suzuki DR650SE is (USD$10000). In case of injury to the rider or breakdown of the motorcycle, the evacuation of the motorcycle is carried out at the expense of the Lessee. Evacuation is carried out by a support vehicle to the nearest place where a transport company or private tow truck will then continue to evacuate the motorcycle to the starting point of the tour. Cost $0.60 per kilometer.
The Participant have to leave the damage deposit in the amount (USD 500) for any possible minor damage. Damage deposit is refundable if there shall not any damages on the motorcycle after tour.

9. PASSPORT, VISAS, HEALTH REGULATIONS, DRIVING LICENCE
Organizer doesn’t deal with visas or visa support. Participant must take care of this yourself.
You shall be responsible for ensuring compliance with the passport, visa, health regulations and driving license, permits of the visited countries and for observance of the respective traffic regulations. If you cannot participate in or must prematurely terminate the tour due to failure to meet these requirements, the organizers of a trip shall be exempt from any liability and shall not be obliged to refund payments to the customer. The main requirement for all countries is a passport which is valid for at least 6 months and an internationally recognized motorcycle driving license. You are also responsible for the safety of your documents and money.

10. INSHURANCES
You are responsible for choosing the insurance company. Make sure that your chosen insurance company will be able to cover in a timely manner the necessary expenses in case of an accident, evacuation in case of injury, damage of rent motorcycle, damage to a third party, refunding money for termination of the tour in case of force majeure and are also able to contact the necessary services in the countries of Central Asia.

11. MOTORCYCLE CLOTHING AND PROTECTION GEAR
Participant of tour are responsible for choosing motorcycle clothing and protective gear.

12. LIABILITY OF ORGANIZER
The organizers of a tour shall be responsible for thorough preparation of motorcycle and the tour, conscientious supervision and careful selection of the service providers as well as the correct execution of the agreed tour services.

13. LIABILITY IN WEATHER
Depending on the season and weather conditions, the tour organizers reserve the right to change the route of the tour and therefore the accommodation if deemed necessary. Organizers always take care to ensure the character of the tour is not altered and make every effort to provide a consistently high standard of services.
The trip dates are chosen such that the prevailing weather conditions in the respective regions are optimally suited to a motorcycle tour. The organizers of a trip shall bear no responsibility for bad weather conditions such as sandstorms, flooded roads and trails, that may occur. The participant shall not be entitled to claim reimbursement of the trip and costs for this reason.

14. FEATURES TOURS
When booking tours, the participant must consciously understand that you are going on a trip to countries with limited infrastructure and low level of services provided (food, accommodations, roads etc.). The participant must understand that the indefinite and not high level of comfort is the very aspect that is part of the appeal of such trips.
The participant determines the degree of adventure by choosing a tour.
Accommodation in hotels, tents and yurts is carried out according to generally accepted local national standards of measurement. Noiselessness, water supply, electricity, food quality and communication are not guaranteed in all cases.
Travel delays and route changes can also be made due to applies to the passage of boundaries and registration points where it takes a lot of time and attention, also the fuel shortages at gas stations or even due to vehicle breakdowns and traffic accidents. In extreme cases, this may jeopardize the dates of return and travel. In such cases, The organizers of a trip shall bear no responsibility for. The participant shall not be entitled to claim reimbursement of the trip and costs for this reason.
Therefore, accept all points of the agreement attentively and treat these conditions with understanding.

15. HEALTH
Before traveling, carefully evaluate your health, your physical capabilities and your motorcycle riding skills. Many sections of the route are far from hospitals and places where medical care can be provided.
Daily tour distances can be very long; driving time can range from 5 to 10 hours, taking into account possible complications of weather conditions (heat, rain and dust storms), as well as poor quality of roads. This requires the participant to be in good physical shape and endurance. Some routes go along high mountain roads where altitude sickness is common. You must be prepared physically and mentally for any travel conditions
